User Agreement

Welcome, and thanks for using and/or other Workacity services and apps! When you use our products and services, you're agreeing to our terms of use, so please take a few minutes to read over the User Agreement below.

1. Introduction

We are a social network and online platform for professionals.

1.1. Purpose

The mission of Workacity is to connect professionals with organizations and other individuals that would benefit from their expertise and talents. To achieve our mission, we make services available through our websites, applications, and developer platforms, to help you, your connections, and other professionals meet, exchange ideas, learn, make deals, find opportunities or employees, work, and make decisions in a network of trusted relationships and groups.

1.2. Scope and Intent

You agree that by registering on Workacity or any Workacity Affiliate Sites (“Workacity”) or by using our websites, applications, developer platforms, premium services, or any content or information provided as part of the Workacity services (“Services”), you are entering into a legally binding agreement with Workacity Inc., #2106-2201 Riverside Drive, Ottawa, Ontario K1H 8K9 (“we,” “us,” “our,” and “Workacity”) on the terms of this Agreement including the Privacy Policy attached as Schedule “A” and Cookie Policy attached as Schedule “B” (collectively referred to as the “Agreement” or the “Terms of Service”), whether as a registered member on and/or other Service, as applicable (“Member”), or unregistered user (“Visitor”). If you are using Workacity on behalf of a company or other legal entity, you are nevertheless individually bound by this Agreement even if your company has a separate agreement with us. If you do not agree with this Agreement, do NOT click “Register” and do not access, view, download or otherwise use any Workacity webpage, content, information or services. By clicking “Register”, “Join Workacity”, “Sign Up” or similar, or by using any Service, you acknowledge that you have read and understood the terms and conditions of this Agreement and that you agree to be bound by all of its provisions.

“Workacity Affiliate Sites” means any domain or website on which Workacity operates its social networking and job posting platform, including without limitation, the following sites:,,,,,,,,,,,,,,,

2. Your Obligations

2.1. License and Warranty for Your Submissions to Workacity

As between you and Workacity, you own the content and information you provide Workacity under this Agreement, and may request its deletion at any time, unless you have shared information or content with others and they have not deleted it, or it was copied or stored by other users. Additionally, you grant Workacity a nonexclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sublicensable, fully paid up and royalty-free right and license to copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, process, analyze, use and commercialize, in any way now known or in the future discovered, any information you provide, directly or indirectly to Workacity, including, but not limited to, any user generated content, ideas, concepts, techniques and/or data, you submit to Workacity, without any further consent, notice and/or compensation to you or to any third parties.

We will respect the choices you make about who gets to see your information and content.

Pursuant to this license, Workacity may grant other Members and/or Visitors access and share rights to your content and information in accordance with this Agreement, your settings and degree of connection with them.

You promise to only provide us information and content that you have the right to give us and you promise that your Workacity profile will be truthful.

Any content or information you submit to us is at your own risk of loss. By providing content or information to us, you represent and warrant that you are entitled to submit it and that it is not confidential and not in violation of any law, contractual restrictions or other third party rights (including any intellectual property rights). Workacity disclaims any responsibility for user created content to links or use of data by third parties.

It is your responsibility to keep your Workacity profile information accurate and updated.

Workacity reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all parts of any content should it determine that such content is in violation with any provision of the Terms of Service.

2.2. Service Eligibility

To be eligible to use the Services, you must meet the following criteria and represent and warrant that you: (1) are at least 18 years old or older; (2) are not currently restricted from the Services, or not otherwise prohibited from having a Workacity account, (3) are not a competitor of Workacity or are not using the Services for reasons that are in competition with Workacity; (4) will only maintain one Workacity account at any given time; (5) will use your real name and only provide accurate information to Workacity; (6) have full power and authority to enter into this Agreement and doing so will not violate any other agreement to which you are a party; (7) will not violate any rights of Workacity or any third party, including intellectual property rights such as copyright or trademark rights; and (8) agree to provide at your cost all equipment, software, mobile access, and Internet access necessary to use the Services.

2.3. Your Membership

You agree to: (1) keep your password secure and confidential; (2) not permit others to use your account; (3) not use other’s accounts; (4) not sell, trade, or transfer your Workacity account to another party; and (5) not charge anyone for access to any portion of Workacity, or any information therein. Further, you are responsible for anything that happens through your account until you close down your account or prove that your account security was compromised due to no fault of your own. To close your Workacity account, please visit your account settings.

2.4. Indemnification

You agree to indemnify us and hold us harmless for all damages, losses and costs (including, but not limited to, reasonable attorneys’ fees and costs) related to all third party claims, charges, and investigations, caused by (1) your failure to comply with this Agreement, including, without limitation, your submission of content that violates third party rights or applicable laws, (2) any content you submit to Workacity, and (3) any activity in which you engage on or through Workacity.

2.5. Payment

If you purchase any services that we offer for a fee, either on a one-time or subscription basis (“Premium Services”), you agree to Workacity storing your payment information. You also agree to pay the applicable fees for the Premium Services (including, without limitation, periodic fees for premium accounts) as they become due plus all related taxes, and to reimburse us for all collection costs and interest for any overdue amounts. Failure to pay may result in the termination of your subscription. Depending on where you transact with us, the type of payment method used and where your payment method was issued, your transaction with us may be subject to foreign exchange fees or differences in prices. Workacity does not support all payment methods, currencies or locations for payment. If the payment method you use with us, such as a credit card, reaches its expiration date and you do not edit your payment method information or cancel your account or such Premium Service, you authorize us to continue billing that payment method and you remain responsible for any uncollected amounts. Your obligation to pay fees continues through the end of the subscription period during which you cancel your subscription. All applicable taxes are calculated based on the billing information you provide us at the time of purchase. Workacity’s refund policy is explained here. We do not guarantee refunds for lack of usage or dissatisfaction. You also acknowledge that Workacity’s Premium Services are subject to this Agreement and any additional terms related to the provision of the Premium Service.

You also agree that by making a payment through a Workacity Affiliate Site or other related entities, that such payment will be processed by Workacity’s payment processing partners. Any information required to process your payment may be disclosed and transmitted by Workacity, its affiliates and other related entities to Workacity’s payment processing partners.

2.6. Notifications and Service Messages

For purposes of service messages and notices about the Services, Workacity may place a banner notice across its pages or the Workacity Affiliate pages to alert you to certain changes such as modifications to this Agreement. Alternatively, notice may consist of an email from Workacity to an email address associated with your account, even if we have other contact information. You also agree that Workacity may communicate with you through your Workacity account or through other means including email, mobile number, telephone, or delivery services including the postal service about your Workacity account or services associated with Workacity. Please review your settings to control and limit what kind of messages you receive from us. You acknowledge and agree that we shall have no liability associated with or arising from your failure to maintain accurate contact or other information, including, but not limited to, your failure to receive critical information about the Services.

2.7. Workacity Applications

Workacity may offer the Services through applications built using Workacity’s platform (“Workacity Applications”). Examples of Workacity Applications include Workacity’s “Share” buttons and other interactive plugins distributed on websites across the web. Workacity Applications are distinct from third party Platform Applications addressed in Section 4.2 (“Third Party Content, Sites and Developers”). If you use a Workacity Application or interact with a website that has deployed a plugin, you agree that information about you and your use of the Services, including, but not limited to, your device, your mobile carrier, your Internet access provider, your physical location, or web pages containing Workacity plugins that load in your browser may be communicated to us. Further, by importing any of your Workacity data through the Workacity Application, you represent that you have authority to share the transferred data with your mobile carrier or other access provider. In the event you change or deactivate your mobile account, you must promptly update your Workacity account information to ensure that your messages are not sent to the person that acquires your old number and failure to do so is your responsibility. You acknowledge you are responsible for all charges and necessary permissions related to accessing Workacity through your mobile access provider. Therefore, you should check with your provider to find out if the Services are available and the terms for these services for your specific mobile devices. Finally, by using any downloadable application to enable your use of the Services, you are explicitly confirming your acceptance of the terms of the End User License Agreement associated with the application provided at download or installation, or as may be updated from time to time.

2.8. User-to-User Communication and Sharing (Messages, Organization Pages, etc.)

Workacity also enables sharing of information by allowing users to post updates, including links and other information such as job opportunities, recommendations, and other content to their profile and other Services, such as Workacity Organization Pages. Workacity members can create Organization Pages for free, however, Workacity, in its sole discretion, may close or transfer Organization Pages, or remove content from them or from anywhere on the Services if the content violates this Agreement or others’ intellectual property rights. Please note that ideas you post and information you share may be seen and used by other Members or Visitors, and Workacity cannot guarantee that others will or will not use the ideas and information that you share on Workacity, nor the manner of use. Therefore, if you have an idea or information that you would like to keep confidential or don’t want others to use, or that is subject to third party rights that may be infringed by your sharing it, do not post it to Workacity. WORKACITY IS NOT RESPONSIBLE FOR ANOTHER’S USE, MISUSE OR MISAPPROPRIATION OF ANY CONTENT OR INFORMATION YOU POST ON WORKACITY.

2.9. Privacy and Cookie Policies

You should carefully read our full Privacy Policy and Cookie Policy before using Workacity as these policies are incorporated into this Agreement by reference and attached as Schedules “A” and “B”, and govern our treatment of any information, including personally identifiable information you submit to us. You acknowledge that your submission of any information, statements, data, and content to us is voluntary on your part and that Workacity may process such information, within the terms of the Privacy Policy.

2.10. Export Control

Your use of Workacity services, including our software, is subject to export and re-export control laws and regulations. You shall not - directly or indirectly - sell, export, re-export, transfer, divert, or otherwise dispose of any software or service to any end-user without obtaining the required authorizations from the appropriate government authorities. You also warrant that you are not prohibited from receiving Canadian origin products, including services or software.

2.11. Contributions to Workacity

By submitting suggestions or other feedback regarding our Services ("Contributions") in any way to Workacity, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Workacity is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Workacity shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) Workacity may have something similar to the Contributions already under consideration or in development; (e) you irrevocably non-exclusively license to Workacity rights to exploit your Contributions; and (f) you are not entitled to any compensation or reimbursement of any kind from Workacity under any circumstances.

3. Your Rights

On the condition that you comply with all your obligations under this Agreement, we grant you a limited, revocable, nonexclusive, nonassignable, nonsublicensable license and right to access the Services, through a generally available web browser, mobile device or Workacity authorized application (but not through scraping, spidering, crawling or other technology or software used to access data without the express written consent of Workacity or its Members), to view content and information and otherwise use the Services, to the extent intended and permitted by the functionality thereof, the Members’ settings and your degree of connection with them, in accordance with this Agreement. Any other use of Workacity contrary to our mission and purpose (such as seeking to connect to someone you do not know or trust, or to use information gathered from Workacity commercially unless expressly authorized by Workacity) is strictly prohibited and a violation of this Agreement. We reserve all rights not expressly granted in this Agreement, including, without limitation, title, ownership, intellectual property rights, and all other rights and interest in Workacity and all related items, including any and all copies made of the Workacity websites.

4. Our Rights and Obligations

4.1. Services Availability

Workacity further reserves the right to withhold, remove or discard any content available as part of your account, with or without notice if deemed by Workacity to be contrary to this Agreement. For avoidance of doubt, Workacity has no obligation to store, maintain or provide you a copy of any content that you or other Members provide when using the Services. Workacity may be required by local laws to remove certain information or content and so that information or content may not be available on our Service in those countries.

4.2. Third Party Content, Sites and Developers

Workacity may include links to third party web sites (“Third Party Sites”) on our Services. Workacity also enables third party developers (“Platform Developers”) to create applications (“Platform Applications”) that provide features and functionality using data and developer tools made available by Workacity through its developer platform. You are responsible for evaluating whether you want to access or use a Third Party Site or Platform Application. You should review any applicable terms or privacy policy of a Third Party Site or Platform Application before using it or sharing any information with it, because you may give the third-party permission to use your information in ways we would not. Workacity is not responsible for and does not endorse any features, content, advertising, products or other materials on or available from Third Party Sites or Platform Applications. Workacity also does not screen, audit, or endorse Platform Applications. Accordingly, if you decide to use Third Party Sites or use Platform Applications, you do so at your own risk and agree that your use of any Platform Application is on an “as-is” basis without any warranty as to the Platform Developer’s actions, and that this Agreement does not apply to your use of any Third Party Site or Developer Application. Please note: If you allow a Platform Application or Third Party Site to authenticate you or connect with your Workacity account, that application or website can access information on Workacity related to you and your connections. For additional information regarding Platform Developers and Platform Applications, please refer to Workacity’s Privacy Policy.

4.3. Disclosure of User Information

You acknowledge, consent and agree that we may access, preserve, and disclose your registration and any other information you provide in accordance with the terms of the Privacy Policy if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary in our opinion to: (1) comply with legal process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce this Agreement; (3) respond to claims of a violation of the rights of third parties, whether or not the third party is a Member, individual, or government agency; (4) respond to customer service inquiries; or (5) protect the rights, property, or personal safety of Workacity, our Members or the public. Disclosures of Member information to third parties other than those required to provide customer support, administer this agreement, or comply with legal requirements are addressed in the Privacy Policy.

4.4. Connections and Interactions with other Members

You are solely responsible for your interactions with other Members. Workacity may limit the number of connections you may have to other Members and may, in certain circumstances, prohibit you from contacting other Users through use of the Services or otherwise limit your use of the Services.

Workacity reserves the right, but has no obligation, to monitor disputes between you and other members and to restrict, suspend, or close your account if Workacity determines, in our sole discretion, that doing so is necessary to enforce this Agreement.

4.5. Intellectual Property Notices

The Services include the copyrights and Intellectual property rights of Workacity and except for the limited license granted to you in Section 3 (“Your Rights”), Workacity reserves all of its intellectual property rights in the Services. Workacity trademarks, service marks, graphics, and logos used in connection with Workacity are trademarks or registered trademarks of Workacity or Workacity Affiliate Sites in Canada and/or other countries. Other trademarks and logos used in connection with Workacity may be the trademarks of their respective owners. This Agreement does not grant you any right or license with respect to any such trademarks and logos whether the property of Workacity or not.

5. Disclaimer


Workacity has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of recruiters or employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, there may be risks, including but not limited to risk of physical harm of dealing with strangers, foreign nationals or people acting under false pretences. You assume all risks associated with dealing with other users with whom you come in contact through the Site.

You release Workacity (and our agents and employees) from all claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with disputes between you and other users of the Service.

You acknowledge and agree that you are solely responsible for the form, content and accuracy of any resume, posting or other content placed by you, as applicable on the Site.

Workacity shall not be responsible for any employment decisions, for whatever reason made, by any entity posting jobs on the Site.

6. Limitation of Liability


7. Termination

7.1. Mutual Rights of Termination

You may terminate this Agreement at any time by closing your Workacity account, not visiting the site, and terminating your Premium Services here. Workacity may terminate this Agreement and your account for any reason or no reason, at any time, with or without notice. This cancellation shall be effective immediately or as may be specified in the notice. For avoidance of doubt, only Workacity or the party paying for the services may terminate your access to any Premium Services. Termination of your Workacity account includes disabling your access to Workacity and may also bar you from any future use of Workacity.

7.2. Misuse of the Services

Workacity may restrict, suspend or terminate the account of any Member who abuses or misuses the Services. Misuse of the Services includes inviting other Members with whom you do not know to connect; abusing the Workacity messaging services; creating multiple or false profiles; using the Services commercially without Workacity’s authorization, infringing any intellectual property rights, using the services for criminal or illegal purposes, or any other behavior that Workacity, in its sole discretion, deems contrary to its purpose. In addition, and without limiting the foregoing, Workacity has adopted a policy of terminating accounts of Members who, in Workacity’s sole discretion, are deemed to be repeat infringers under the Copyright Act of Canada.

7.3. Effect of Termination

Upon termination of your Workacity account, you lose access to the Services. The terms of this Agreement shall survive any termination, except Section 3 (“Your Rights”) and Sections 4.1, 4.2, and 4.3 (“Our Rights and Obligations”).

8. Dispute Resolution

8.1. Law and Forum for Legal Disputes

All questions, controversy, or claims arising out of or relating to this Agreement shall be referred to arbitration as herein provided by one party giving notice to the other. Any dispute arising out of or in connection with this Agreement that is referred to arbitration shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce (the “ICC Rules”) by one or more arbitrators appointed in accordance with the ICC Rules. The place of arbitration shall be Ottawa, Canada. The language of the arbitration shall be English.

9. General Terms

9.1. Severability

If any provision of this Agreement is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; if a court or arbitrator finds the modified provision invalid, illegal, void or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement will not be affected in any way.

9.2. Language

Where Workacity has provided you with a translation of the English language version of this Agreement, the Privacy Policy, site content, or any other documentation, you agree that the translation is provided for your convenience only and that the English language versions of this Agreement, the Privacy Policy, site content, and any other documentation, including additional terms of service for Premium Services, will govern your relationship with Workacity.

9.3. Entire Agreement

You agree that this Agreement constitutes the entire, complete and exclusive agreement between you and Workacity regarding the Services and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of this Agreement. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Workacity services, third-party content or third party software.

9.4. Amendments

We reserve the right to modify, supplement, or replace the terms of this Agreement, effective prospectively upon posting at or notifying you otherwise. For example, we may present a banner on the Services when we have amended this Agreement or the Privacy Policy so that you may access and review the changes prior to your continued use of the Services. If you do not want to agree to changes to this Agreement, you can terminate this Agreement at any time per Section 7 (“Termination”).

9.5. No Informal Waivers, Agreements or Representations

Our failure to act with respect to a breach of this Agreement by you or others does not waive our right to act with respect to that breach or subsequent similar or other breaches. Except as expressly and specifically contemplated by the Agreement, no representations, statements, consents, waivers or other acts or omissions by any Workacity Affiliate shall be deemed legally binding on any Workacity Affiliate, unless documented in a physical writing hand signed by a duly appointed officer of Workacity.

9.6. No Injunctive Relief

In no event shall you seek or be entitled to rescission, injunctive or other equitable relief, or to enjoin or restrain the operation of the Services, exploitation of any advertising or other materials issued in connection therewith, or exploitation of the Services or any content or other material used or displayed through the Services.

9.7. Assignment and Delegation

You may not assign or delegate any rights or obligations under the Agreement. Any purported assignment and delegation shall be ineffective. We may freely assign or delegate all rights under the Agreement, fully or partially without notice to you. We may also substitute, by way of unilateral novation, effective upon notice to you, Workacity Inc. for any third party that assumes our rights under this Agreement.

Schedule “A”

Privacy Policy

We protect your personal information using industry-standard safeguards. We may share your information with your consent or as required by law as detailed in this policy, and we will always let you know when we make significant changes to this Privacy Policy.

Maintaining your trust is our top priority, so we adhere to the following principles to protect your privacy:

  • We protect your personal information and will only provide it to third parties: (1) with your consent; (2) where it is necessary to carry out your instructions; (3) as reasonably necessary in order to provide our features and functionality to you; (4) when we reasonably believe it is required by law, subpoena or other legal process; or (5) as necessary to enforce our User Agreement or protect the rights, property, or safety of Workacity, its Members and Visitors, and the public.

  • We have implemented appropriate security safeguards designed to protect your information in accordance with industry standards.

This Privacy Policy applies to and all other Workacity and Workacity Affiliate Sites websites, apps, developer platforms and other products and services (collectively “Workacity” or the “Services”). We may modify this Privacy Policy from time to time, and if we make material changes to it, we will provide notice through our Service, or by other means so that you may review the changes before you continue to use Workacity. If you object to any changes, your sole remedy is to close your account. Continuing to use Workacity after we publish or communicate a notice about any changes to this Privacy Policy means that you consent to the changes.

1. What Information We Collect

Our Privacy Policy applies to any Member or Visitor. If you have any concern about providing information to us or having such information displayed on the Workacity services or otherwise used in any manner permitted in this Privacy Policy and the User Agreement (together also referred to as Workacity’s Terms of Service), you should not become a Member of Workacity, visit our websites, apps or otherwise use our Services. If you have already registered, you can close your account here. We collect your personal information in the following ways:

1.1. Registration

When you create an account with us, you provide us with information (including your name, email address, and password) that we use to offer you a personalized, relevant experience on Workacity.

You understand that, by creating an account, Workacity and others will be able to identify you by your Workacity profile, and you allow Workacity to use this information in accordance with this Privacy Policy and our User Agreement. We may also ask for your credit card details if you purchase certain Workacity services.

1.2. Profile Information

You can add professional details – like your job title, education, and skills – to your profile. A complete profile helps you be found by other people for opportunities. It also means we can show you relevant ads and content.

Most of your Workacity profile, as well as all content that you post on Workacity, is publicly displayed (with the exceptions provided in the Workacity account settings), so please do not provide personal information you would not want to be public. We may use and share information in accordance with this Privacy Policy and our User Agreement.

1.3. Address Book and Other Services That Sync with Workacity

We collect information when you sync non-Workacity content – like your email address book, mobile device contacts, or calendar – with your account. We use this information to improve your experience and allow you and your network to be better connected. You can remove your address book and any other synced information whenever you'd like.

Any information that you upload or sync with Workacity is covered by the User Agreement and this Privacy Policy. You can remove your information at your convenience using the features Workacity makes available or in accordance with Section 3 (“Your Choices and Obligations”). You can remove your address book and any other synced information at any time.

1.4. Customer Service

When you contact our customer support services (e.g. via Workacity’s “Contact us” page), we collect information that helps us categorize your question, respond to it, and, if applicable, investigate any breach of our User Agreement or this Privacy Policy. We also use this information to track potential problems and trends and customize our support responses to better serve you.

1.5. Using the Workacity Sites and Applications

We collect information when you use (whether as a Member or a Visitor) the Workacity websites, applications, Workacity platform technology (such as “Share on Workacity” plugins for publishers) or other Services. If you are logged in on or a Workacity app or another Service or a Workacity cookie on your device identifies you, your usage information and the log data, such as your IP address, will be associated with your account. Even if you’re not logged into a Service, we log information about devices used to access our Services, including IP address.

1.6. Using Third-Party Services and Visiting Third-Party Sites

We collect information when you view web pages that include Workacity plugins. When you visit a third-party site that embeds Workacity professional plugins (such as “Share on Workacity” for publishers) we receive information that those pages have loaded in your web browser. If you are logged in as a Member when you visit sites with Workacity plugins, we use this information to recommend tailored content to you. Workacity will use this information to personalize the Workacity-provided functionality on third-party sites. Workacity’s retention of this data is addressed in Section 3.2 (“Data Retention”). We do not use this information for advertising. Workacity may provide reports containing aggregated impression information to companies hosting Workacity plugins and similar technologies to help them measure Workacity-generated traffic to their websites.

1.7. Cookies

We use cookies and similar technologies to help us recognize you across different Services, improve your Workacity experience, increase security, measure use and effectiveness of our Services, and serve advertising. You can control cookies through your browser settings and other tools. For more information, including the types of cookies found on Workacity, please read Workacity’s Cookie Policy attached below as Schedule “B”. By visiting Workacity, you consent to the placement of cookies and beacons in your browser and HTML-based emails in accordance with this Privacy Policy and Workacity’s Cookie Policy.

1.8. Advertising Technologies and Web Beacons

We target ads to Members and Visitors both on and off Workacity through a variety of ad networks and ad exchanges, using:

  1. Advertising technologies like web beacons, pixels, ad tags, cookies, and mobile identifiers as permitted by mobile platforms both on and off Workacity;

  2. Member-provided profile information and categories (for example, “software architect in Ontario”);

  3. Information inferred from a Member’s profile (for example, using job titles to infer age, industry, seniority, and compensation bracket; or names to infer gender);

  4. Your use of Workacity (for example, your Workacity search history, the content you read, who you follow or is following you) or clicking on a Workacity ad;

  5. Information from advertising partners which we use to help deliver ads more relevant to you.

We do not share personally identifiable information with any third-party advertiser or ad network, although your profile is visible to other Members and through public search depending on your settings.

Please note that all social actions on Workacity (e.g. liking certain content, following or being followed by others) are public, unless expressly specified otherwise.

1.9. Log Files, IP Addresses, and Information About Your Computer and Mobile Device

When you visit or leave Workacity sites or apps (whether as a Member or Visitor) by clicking a hyperlink or when you view a plugin on a third-party site, we automatically receive the URL of the site from which you came or the one to which you are directed. Also, advertisers receive the URL of the page that you are on when you click an ad on Workacity. We also receive the Internet protocol (“IP”) address of your computer or the proxy server that you use to access the web, your computer operating system details, your type of web browser, your mobile device (including your mobile device identifier provided by your mobile device operating system), your mobile operating system (if you are accessing Workacity using a mobile device), and the name of your ISP or your mobile carrier. We may also receive location data passed to us from third-party services or GPS-enabled devices that you have set up, which we use to show you local information on our mobile applications. Most mobile devices allow you to prevent real time location data being sent to Workacity, and of course Workacity will honor your settings.

In the case of our mobile apps, you will be provided notice of the types of data (e.g. location) that will be sent to us. If you choose to use our app after this notice, we process this data to enable registration or preview product features for you (e.g. jobs near you). If you choose not to become a Member, we will delete this information.

2. How We Use Your Personal Information

Workacity will only use your personal information for the purposes we mention in this Privacy Policy.

2.1. Customized Content

We use information that you provide to us to customize your experience and the experiences of others on Workacity. For example, when you sign in to your account, we may display the names of new Members who have recently joined your network or recent updates from your connections and companies you follow. We also use aggregated information from your network and other users to show you content, such as news and presentations relevant to you, your industry, or your profession.

2.2. Sharing Information with Affiliates

We may share your personal information with our Workacity Affiliate Sites outside of the Workacity entity that is your data controller (for example, Workacity Inc. may share your information with other Workacity operating entities such as as necessary to provide the Services. By agreeing to this Privacy Policy, you are consenting to this sharing.

2.3. Sharing Information with Third Parties

Any information you put on your profile and any content you post on Workacity may be seen by others. We don’t provide any of your non-public information (like your email address) to third parties without your consent, unless required by law, or as described in this Policy. Other people may find your Workacity profile information through search engines.

Workacity offers a “public profile” feature that allows Members to publish portions of their Workacity profile to the public Internet. This public profile will be indexed and displayed through public search engines when someone searches for your name.

We do not rent or sell personal information that you have not posted on Workacity, except as described in this Privacy Policy. We will not disclose personal information that is not published to your profile or generated through engagement with other Workacity services, such as Job and Organization Pages, without your consent or to carry out your instructions (for example, to process payment information) unless Workacity has a good faith belief that disclosure is permitted by law or is reasonably necessary to: (1) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce this Privacy Policy or our User Agreement; (3) respond to claims of a violation of the rights of third parties; (4) respond to Member service inquiries; or (5) protect the rights, property, or safety of Workacity, our Members, Visitors, or the public.

Content distributed through Workacity’s sharing features and third-party integrations may result in displaying some of your personal information outside of Workacity. For example, when you post content to an Organization Page that is open for public display, your content, including your name as the contributor, may be displayed in search engine results. Further, Workacity allows third parties to look-up profile information (subject to your privacy settings) using your email address or first and last name information through its profile API (see Section 2.4 below).

Third parties (for example, your email provider) may give you the option to upload certain information in your Workacity contacts onto their own service. If you choose to share your Workacity contacts, you will be granting your third party provider the right to store, access, disclose and use your Workacity contacts in the ways described in such third party's terms and privacy policy.

2.4. Third Parties Using Workacity Platform Services

We work with developers to build Platform Applications using Workacity’s developer tools. Whether you use Platform Applications is up to you. If you have given a Platform Application access to your Workacity account, you can revoke that permission anytime.

We collaborate with and allow third parties to use Workacity’s developer platform to offer services and functionality in conjunction with Workacity. These third-party developers have either negotiated an agreement to use Workacity platform technology or have agreed to our self-service API and Plugin terms in order to build applications (“Platform Applications”). Both the negotiated agreements and our API and Plugin terms contain restrictions on how third parties may access, store, and use the personal information you provide to Workacity. If you choose to use a Platform Application, you will be asked to confirm acceptance of the privacy policy and user agreement of the third-party developer. To revoke permission granted to a Platform Application, please visit your settings.

2.5. Talent Recruiting, Marketing and Sales Solutions

We offer customized people-search functionality along with organizational and communications tools as part of our talent recruiting, marketing and sales solutions. These services allow subscribers – generally, enterprises and professional organizations - to export limited information from Members’ public profiles, such as name, personal profile, organizations, and location (for example, Ottawa Area), in order to effectively manage candidate sourcing. We do not provide email or other contact information to these subscribers. However, if you post that information as part of your profile it will be available to them and others. A recruiter or other such subscriber may also manage and store information it has independently obtained about you outside of our Services, such as a resume, in connection with Workacity’s platform. Any personal information obtained independently of Workacity services will not be added by Workacity to your profile and is not under Workacity’s control but is subject to the policies of the Workacity recruiting, marketing or sales solution subscriber. We store such information on behalf of such subscriber who can remove it at any time. We do not further process such information.

2.6. Pages for Organizations and Other Entities

Organizations and other entities can create pages on Workacity. If you follow one of these pages, you’ll be listed as one of the company’s followers, and non-identifiable information about you will be provided to the page’s administrators.

Workacity allows companies, schools, charities, and other organizations as well as thought leaders and influencers to create pages dedicated to their brand, business, and mission. These pages are public, and any communications or information shared through them will be accessible by the entity that created them. If you follow a person or organization, you will be listed among its followers, which can be viewed by others. Workacity uses aggregate information about followers and viewers to provide data about its performance (for example, visits and updates).

2.7. Compliance with Legal Process and Other Disclosures

We may disclose your personal information if compelled by law, subpoena, or other legal process, or if necessary to enforce our User Agreement.

2.8. Disclosures to Others as the Result of a Change in Control or Sale of Workacity Inc.

We may also disclose your personal information to a third party as part of a sale of the assets of Workacity Inc., a subsidiary, or division, or as the result of a change in control of the company or one of its affiliates, or in preparation for any of these events. Any third party to which Workacity transfers or sells Workacity’s assets will have the right to continue to use the personal and other information that you provide to us in the manner set out in this Privacy Policy.

2.9. Service Providers

We may employ third party companies and individuals to facilitate our Services (e.g. maintenance, analysis, audit, marketing and development). These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to Workacity not to disclose or use it for other purposes.

3. Your Choices and Obligations

3.1. Rights to Access, Correct, or Delete Your Information, and Closing Your Account

We recognize your right to your personal information we have collected. We will make the effort to inform you of what information we have on you. 3.2. Data Retention

We retain the personal information you provide while your account is in existence or as needed to provide you services. Workacity may retain your personal information even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between Members, prevent fraud and abuse, or enforce this Privacy Policy and our User Agreement. We may retain personal information, for a limited period of time, if requested by law enforcement. Workacity's Customer Service may retain information for as long as is necessary to provide support-related reporting and trend analysis only, but we generally delete or de-personalize closed account data consistent with Section 3.1 (“Rights to Access, Correct, or Delete Your Information, and Closing Your Account”), except in the case of our plugin impression data, which we will try to de-personalize at the time of collection, but in any event, we will de-personalize within 7 days.

4. Important Information

4.1. Changes to this Privacy Policy

We will notify you when we change this Privacy Policy.

We may change this Privacy Policy from time to time. If we make significant changes in the way we treat your personal information, or to the Privacy Policy, we will provide notice to you on the Services or by some other means, such as email. Please review the changes carefully. If you agree to the changes, simply continue to use our Services. If you object to any of the changes to our terms and you no longer wish to use Workacity, you may close your account(s). Unless stated otherwise, our current Privacy Policy applies to all information that Workacity has about you and your account. Using Workacity after a notice of changes has been communicated to you or published on our Services shall constitute consent to the changed terms or practices.

4.2. Security

We have implemented security safeguards designed to protect the personal information that you provide in accordance with industry standards. Access to your data on Workacity is password-protected, and sensitive data (such as credit card information) is encrypted using commercially reasonable and up-to-date encryption methods when it is exchanged between your web browser and the Workacity Services. We also offer secure https access to the website. To protect any data you store on our servers, we also regularly monitor our system for possible vulnerabilities and attacks, and we use a secured-access data center. However, since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information that you transmit to Workacity. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails, instant messaging, and similar means of communication with other Members are not encrypted, and we strongly advise you not to communicate any confidential information through these means. 1. Does Workacity use cookies?

Workacity uses cookies and similar technologies to provide you with the best possible experience on our website.

A cookie is a small file placed onto your device. Cookies enable us to identify your device, and enable the functioning of many Workacity features, including your ability to log into your account.
